    Agreement to Terms

    By accessing or using the Abixon Digital website (abixondigital.com), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our website.

    Our Services

    Abixon Digital provides web design, development, hosting, maintenance, and related digital services for small businesses. The specific scope, deliverables, and pricing for any project are outlined in a separate service agreement between Abixon Digital and the client.

    Intellectual Property

    All website designs, code, and graphics created by Abixon Digital are licensed to you while your monthly agreement is active. You own your domain name, your content (text, images, logos), and your data at all times. Ownership of the website source code and design files transfers to you once you have either (a) paid for the build upfront, (b) completed the full monthly agreement term specified in your service agreement, or (c) settled the prorated remaining months of your agreement after early cancellation. After ownership transfers, the website code and design files are yours to host, modify, or migrate as you choose. Our reusable internal tools, components, frameworks, and development processes - the systems we use to build for many clients - remain our intellectual property and are never transferred.

    Client Content

    You are responsible for providing accurate content (text, images, logos, etc.) for your website. You represent that you have the right to use any content you provide to us. Abixon Digital is not liable for any copyright or trademark issues arising from content supplied by the client. All content you provide remains your property at all times.

    Use of This Website

    You agree to use this website for lawful purposes only. You may not attempt to interfere with the website's functionality, introduce malicious code, or access areas of the website that are not intended for public use.

    Payment Terms

    Monthly plans start at $150 per month. Specific pricing, billing cadence, and any minimum commitment are determined during the quote process and outlined in your service agreement. Payments are due on the date specified in your agreement. Late payments may result in service suspension after a 7-day grace period.

    Cancellation

    Cancellation terms depend on the plan specified in your individual service agreement. (1) Redesign plans run on a 6 to 12 month agreement with the term length determined by project scope. If you cancel before the agreement term is complete, you are responsible for the prorated remaining months of your agreement. Once that balance is settled, ownership of the website source code and design files transfers to you. If you complete the full agreement term before cancelling, ownership transfers automatically at term end. After ownership transfers, you may keep the site hosted with us at $40 per month for hosting and maintenance, or migrate it to a host of your choice. If a prorated balance is not settled after early cancellation, the website may be taken offline until the balance is paid, and unpaid balances may be referred to collections or other legal remedies as outlined in your service agreement. (2) Tune-Up plans cancel any time after a 3-month minimum, with no ownership transfer applicable because the customer retains their existing website throughout. (3) One-time upfront build projects: the website is yours at launch, with optional hosting and maintenance available at $40 per month. In every scenario, your domain and any content you provided to us remain yours throughout and are formally released to your direct control upon cancellation.

    Limitation of Liability

    Abixon Digital is not liable for any indirect, incidental, or consequential damages arising from the use of our website or services. Our total liability for any claim related to our services is limited to the amount you paid us in the 12 months preceding the claim. We do not guarantee specific business results, search engine rankings, or traffic from any website we build.

    Third-Party Links

    Our website may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of these external websites. Visiting them is at your own risk.

    Disclaimer of Warranties

    Our website and services are provided "as is" without warranties of any kind, either express or implied. While we make every effort to keep our website accurate and up to date, we do not guarantee that it will be error-free or uninterrupted.

    Governing Law

    These terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved in the state or federal courts located in Florida.

    Changes to These Terms

    We reserve the right to update these Terms and Conditions at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Continued use of our website after changes are posted constitutes acceptance of the updated terms.
